EU en Gazprom sluiten akkoord over gastransport

31 oktober 2016De EU staat Gazprom toe meer gas buiten Polen en Oekraïne om naar de EU te transporteren. Het was een lastige beslissing voor de EU, omdat het Rusland meer invloed kan geven op Oost-Europa.

Vrijdag besloot de Europese Commissie akkoord te gaan met de verruiming van de mogelijkheden voor Gazprom. Het gaat om transportfaciliteiten, met name om de Opal-leiding in Oost-Duitsland die de vervolgleiding is voor het gas dat via de Nord Stream 1-leiding wordt aangevoerd en verbinding maakt met Tsjechië. Tot nu toe mocht Gazprom maximaal 50% van de Opal-leiding gebruiken om zo de macht van Gazprom te beperken. Nu mag Gazprom, onder voorwaarden,  ook gaan bieden op het gebruik van de resterende capaciteit van de leiding en dat kan in de praktijk gaan betekenen dat 90% van het gebruik van de leiding bij Gazprom kan terechtkomen.

‘(…) The Commission has today adopted stricter exemption conditions for the operation of the OPAL gas pipeline. The Commission wants to ensure properly functioning liquid and competitive gas markets in Europe, and today’s decision follows these guidelines.
A competitive EU gas market where energy companies can trade freely and have easy access to pipelines is essential for ensuring secure and affordable supplies to all EU citizens and is a priority under the Energy Union strategy.
Since its launch in 2011, OPAL has been to a 100% exempt from EU internal energy market rules on third party access and tariff regulation. Now, according to the revised decision, the use of only 50 % of OPAL’s capacity will be exempt from third party access rules and the operation of the other 50 % of the pipeline capacity will be covered by stringent EU market rules. These rules ensure transparent and non-discriminatory access to all gas companies. Moreover, additional conditions are now in place in order to create better trading possibilities for all market participants.
In its decision, the Commission finds that while changes to the initial exemption decision are justified in view of market changes since 2009, more stringent conditions are neededto ensure fair and non-discriminatory access to the pipeline for all market participants and thus contribute to market integration, security of supply and improved competition on the Czech market. In its decision, the Commission notably requests that a significant amount of the pipeline’s capacity has to be made available as a reliable – so called “firm” – capacity for competitors. Under given conditions, the Commission may even revise this threshold further upward. In addition, companies with a dominant position on the Czech market are not allowed to outbid other users of the pipeline for this capacity, while added monitoring obligations provide further safeguards for the pipeline to contribute to market integration and competition. ‘(…) Volgens de Europese regels moeten energienetwerken ook openstaan voor derden om marktwerking te garanderen. Omdat Gazprom zowel eigenaar is van de pijpleiding als leverancier van het gas werd er een limiet gehanteerd voor Opal. (…)

The Wall Street Journal schrijft dat dit akkoord betekent dat Europa en Rusland ondanks de spanningen om Syrië wel pragmatisch zaken kunnen doen. Maar het is volgens de krant wel een slechte zaak voor Oekraïne. Rusland gebruikt Nord Stream en de aanverwante Opal-pijpleiding om minder Russisch gas door Oekraïne te laten stromen, waardoor het zijn functie als doorvoerland van gas langzaamaan verliest. (…)’

‘(…) Het gaat om een politiek gevoelige beslissing, omdat Gazprom door de Russische staat wordt gecontroleerd. Met gaspolitiek kan Rusland nog altijd invloed houden op Oost-Europa. (…) Het Commissiebesluit komt op een moment dat er ook met Gazprom wordt gesproken over een schikking bij een grote Europese mededingingszaak. Het Russische concern werd vorig jaar door eurocommissaris Margrethe Vestager (mededinging) ervan beschuldigd zijn dominante positie te misbruiken in acht landen in Midden- en Oost-Europa. (…) Bronnen bij de Europese Commissie zeggen dat beide zaken los van elkaar staan. (…)’

‘Besluit ook van belang voor Nord Stream 2’

Karel Beckman van Energy Post wijst erop dat het besluit van de Europese Commissie (samen met de oplossing voor de mededingingszaak) o0k van belang is voor de plannen voor Nord Stream 2 (door de Blatische Zee, naast Nord Stream 1).
‘(…) This is no doubt good news for Nord Stream 2, the controversial gas pipeline that Gazprom wants to build through the Baltic Sea to Germany alongside the first Nord Stream, and which is being strongly opposed by Ukraine, Poland and other Eastern European countries. It looks increasingly unlikely now that Brussels will block Nord Stream 2. (…) Personally, I believe that this is a positive development. I don’t think Europe needs to be afraid of Nord Stream 2. (…) In my view, the EU’s successful creation of a competitive, integrated gas market has made geopolitical arguments (fear of dependence on Russia) redundant. (…)’
