Vijftien staten vragen rechter Obama’s klimaatplan te blokkeren

14 augustus 2015 – Vijftien Amerikaanse staten hebben de federale rechtbank om de implementatie van Obama’s Clean Power Plan te bevriezen. Het is de eerst juridische stap om het vorige week gelanceerde klimaatplan tegen te houden.

Intussen bereiden de staten, aangevoerd door het kolenproducerende West Virginia, zich voor op een zware juridische strijd. Obama wil de CO2-uitstoot in 2030 (ten opzichte van 2005) verminderen met 32 procent. Sluiten van kolencentrales is daarbij onvermijdelijk. Het plan stuit op grote bezwaren van de Republikeinen en industrie (met name de kolenindustrie).

‘(…) They say the policy written by the Environmental Protection Agency, a regulator, breaches states’ rights and will hurt the economy by raising electricity prices and jeopardising the reliability of power supplies.
Patrick Morrisey, West Virginia’s attorney-general, said: “This rule is the most far-reaching energy regulation in the nation’s history, and the EPA simply does not have the legal authority to carry it out. The EPA is attempting to transform itself from an environmental regulator to a central planning agency for states’ energy economies.” (…)’

In een commentaar in de Huffington Post schrijft David Spence (hoogleraar business, government and society aan de McCombs School of Business en hoogleraar energy law aan de Universiteit van Texas): ‘we can look forward to years of legal challenges to the Clean Power Plan’. Spence geeft drie redenen:

  • De dreiging voor de kolenindustrie is enorm en ze hebben niets te verliezen;
  • Sommige staten die profiteren van het plan, zullen zich toch bij de tegenstanders scharen om Obama politiek in een hoek te drijven;
  • En er zijn geloofwaardige juridische argumenten aan te voeren tegen het plan, stelt Spence.
